Governing Law & Jurisdiction
These Terms of Use and any dispute, controversy or claim arising out of or relating to them — including any questions regarding their existence, validity, interpretation, breach or termination — shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil, without regard to conflict-of-laws principles.
The parties irrevocably submit to the exclusive jurisdiction of the competent courts of the State of Bahia, Brazil to resolve any dispute arising out of or in connection with these Terms or your use of the Website. If applicable law in your jurisdiction provides for mandatory alternative courts or dispute-resolution mechanisms, nothing in this clause shall operate to exclude them.
To the extent that any dispute is not subject to mandatory arbitration or alternative dispute resolution, you and Bahia House each expressly waive any right to a trial by jury or any right to bring claims in any class, consolidated or representative action, to the extent permitted by applicable Brazilian law.
Bahia House is a registered real estate brokerage operating in compliance with Brazilian federal and state regulations governing the profession, including the standards set by the Regional Council of Real Estate Brokers (CRECI-BA). Nothing in these Terms is intended to exclude any right or remedy that a consumer may be entitled to under the Brazilian Consumer Defense Code.
